What are the Poster Requirements for Remote Workers?

If you have employees working remotely due to COVID-19, you may need to order more State/Federal employment law posters than normal for 2021. Wondering how to satisfy your obligation to post the required notices conspicuously in the employees' "place of work?" Below are some common questions and answers about posting requirements:

Am I obligated to send required notices to my remote employees even if they are posted at our company's worksite?

It depends. If your remote employees are operating 100% remotely — meaning they never come to the worksite at any point during the year — you must send each of your remote employees all of the state and federal notices. If your remote employees report to the worksite, even occasionally, you have satisfied your obligation as long as the notices are posted conspicuously at your company.

Can I email all required notices to my 100% remote workers or post them on our company website?

No. Aside from only a few exceptions — such as the California pregnancy disability leave notice — most state and federal labor law posters must be provided as hardcopies to satisfy compliance. As such, you should mail the required posters to the employees' addresses on record for workers who operate 100% remotely.

Does CEA's all-in-one poster for 2021 include COVID-19 leave notices for FFCRA and AB 1867?

No. These leave requirements currently expire on December 31, 2020, so they will not be included in CEA's 2021 poster.
