“Boo-ze” & Witches Brew: Is Serving Alcohol at a Company Party a Good Idea?

Hosting a Halloween party for your staff can be a great way to boost employee morale and a fun way to kick off the holiday season. However, if you’re considering serving alcohol at your event, things can get tricky. In California, courts have made clear that employers can be held liable for what happens after the party comes to an end.

What Are the Risks?

When you allow employees to drink at a company-sponsored event, employers should be aware it may increase the risk of:

  • Safety concerns and accidents after the event, especially drunk driving incidents.
  • Sexual harassment or inappropriate behavior fueled by alcohol.
  • Workers’ compensation claims may be filed if an employee is injured.
  • Reputational damage if photos or videos circulate online.

Many employers decide that the benefits of serving alcohol are outweighed by the potential risks. Others implement safeguards to ensure that staff members enjoy drinks in moderation and a safe manner.

Best Practices for a Spooktacular Event

If you’re considering serving alcohol at your Halloween bash, best practices include:

  • Make Attendance Voluntary: Some staff members may not be comfortable being present while alcohol is served.
  • Hire Bartenders: Ensure bartenders are RBS certified as required under California’s Responsible Beverage Service Training Program.
  • Limit Alcohol Consumption: Consider using drink tickets to limit the number of drinks each guest can have, and serve beer and wine only. Close the bar well in advance of the event ending to reduce the risk of post-party accidents.
  • Provide Food and Non-Alcoholic Options: Always serve substantial food alongside alcoholic beverages, and provide water and non-alcoholic drinks to ensure proper hydration.
  • Remove Safety Hazards: Combining alcohol with dim lighting or decorations can create tripping hazards—ensure paths are clear and well-lit.
  • Provide Transportation or Hotel Accommodations: Consider arranging group transportation and designated drivers. Alternatively, provide Uber, Lyft, or taxi vouchers or offer to reimburse for travel expenses home. You may also decide to hold the event within walking distance of hotel accommodations provided to staff.
  • Remind Employees of Your Policies: In advance of the event, it is best to send a written reminder regarding specific policies and potential consequences for violation, such as:
    • Harassment Prevention
    • Code of Conduct
    • Alcohol Consumption

For example, your correspondence may include a statement such as:

Alcohol may be served at this event. Employees are expected to drink responsibly and to behave professionally at all times. Inappropriate conduct, such as harassment or excessive intoxication, will not be tolerated. Our company policies will be fully enforced at this event. Policy violations may result in disciplinary action, up to and including termination of employment.

Halloween parties can be a fun way to celebrate with your team, but when alcohol is involved, employers should take extra precautions. By setting clear expectations, limiting consumption, and planning for safe transportation in advance, you can focus on the fun and the treats and avoid any tricks!
